European ISPs Want Rightsholders Held Accountable for Overblocking Damage

European Internet Service Providers (EuroISPA) are urging the European Commission to hold copyright holders accountable for damages caused by overblocking site-blocking measures, citing numerous incidents across Europe where legitimate services were inadvertently blocked alongside pirate sites. The organization argues that existing laws are sufficient and that the real problem lies in enforcement, not legislative gaps, while highlighting how site-blocking expansion to DNS resolvers and VPN providers has caused collateral damage affecting millions of users' access to banking apps, payment platforms, and other legitimate services. EuroISPA proposes that rightsholders should be liable for overblocking damage through clearly defined compensation mechanisms, a requirement already supported by existing EU intellectual property law.
